What is S. 753?
(Updated December 27, 2020)
This bill would ensure married same-sex couples have access to Social Security benefits wherever they move in the country by amending a portion of the Social Security Act to guarantee retirement and survivor benefits to same-sex couples living in a state that doesn't recognize marriage equality.
Argument in favor
Provides marriage equality with something akin to a reverse underground railroad. One step closer to equality that is long overdue.
Argument opposed
Forcing a state to recognize a union that it otherwise wouldn't infringes on that state's rights, and establishes a dangerous legal precedent.
Impact
The bill impacts Social Security benefits for same-sex couples who were legally married in a jurisdiction that recognizes marriage equality and then move to a state that doesn't recognizes the couple's marriage as legal.
Cost of S. 753
A CBO cost is currently unavailable.
Additional Info
Of Note:
In late June of 2013, the Supreme Court's first rulings on same-sex marriage found that same-sex married couples living in states where gay marriage is legal must receive the same health, tax and Social Security benefits heterosexual couples receive.Media:
