Do Sanctuary Cities That Don't Cooperate With Immigration Officials Need to Lose Federal Funding?

Argument in favor

Sanctuary cities encourage illegal immigration and endanger public safety — they don't deserve federal funding. Plus, mandatory minimums will help deter more illegal immigration.

Senator Gillibrand the only way I am grateful that you responded to my opinion on the Stop Dangerous Sanctuary Cities Act is that you did respond. However your opinion in your response is invalid. It is your job to represent your constituents of whom I am one. Therefore your vote should be a representation of your constituents rather than your own opinion. you're voting record in my opinion is pitiful and nothing more than political party hack nonsense. This act needs to be voted on for its legal and constitutional basis. Continuing to call illegal aliens who commit crimes and are not reported to ICE as undocumented immigrants is nothing more than an abject lie. Your job is only to represent your constituents. Shame on you.

Sanctuary Cities must be stopped in subverting the LAW. Each City, County or State must stop spending taxpayer money on illegal aliens.

THIS Bill MUST BE PASSED! NO CRIMINAL MUST BE ABLE TO ESCAPE THE CONSEQUENCES OF HIS/HER ILLEGAL ACTIONS, AND ILLEGAL ALIENS ARE BY DEFINITION CRIMINALS, WHO HAVE AT THE VERY LEAST BROKEN OUR IMMIGRATION LAWS. MANY, AS DONALD TRUMP SAID, ARE RAPISTS, MURDERERS, AND DRUG TRAFFICKERS. THE PEOPLE WHO HELP THEM ARE NOT UPHOLDING THE RULE OF LAW!

Argument opposed

It's wrong to force immigration laws on communities that don't support them. This bill threatens to erode community trust in law enforcement as an overreactive response to an unfortunate event.

What is the point of a sanctuary that isn't safe? I thought conservatives liked local control of local situations? Now you don't trust local people decide whether or not to use their resources to help immigrants in their communities if it is their choice? Make up you bloody minds! You obviously trust all white Americans to be armed to teeth--no matter what their level of mental health, you foam at the mouth if a school district is asked to accommodate a transgender child, you can't stand for a local public official to be required do his/her job if he/she finds the federal law offensive. And yet, that a local jurisdiction would make a choice to not participate fully in INS enforcement is somehow worthy of your outrage? Go back to your witch hunts for pregnant women & patrolling bathrooms. You are clearly confused about your priorities unless an issue tangentially involves sex. This does not so take a deep breath & decide who you REALLY hate. The scatter shot approach is unconvincing!

I am disgusted by what people are saying about "illegals". These "illegals" are human beings. Human beings who have left their homes often out of fear for their safety and the wellbeing of their families. Some of these "illegals" are children. You are dehumanizing millions of people by calling all illegal immigrants rapists and murders. Do you feel safe in your house? In your country? Then you are blessed and should recognize that. It is unbelievable to me how swift people are to defund programs that help others even when it is obvious that our global communities and our national communities are hurting.

What is Senate Bill S. 3100?

This bill aims to hold sanctuary cities and jurisdictions accountable for defying federal immigration laws. It would increase penalties for those who illegally re-enter the U.S. after being deported.

Sanctuary jurisdictions are defined as states or localities that prohibit law enforcement officers from cooperating with federal immigration officials — even if they wish to do so. Under this bill, the Dept. of Homeland Security (DHS) would create a list of jurisdictions that meet this definition and make it publicly available.

Federal grant funding for law enforcement would be withheld from sanctuary jurisdictions, and made available to other states and localities that allow their law enforcement officers to cooperate with federal immigration officials.

Local law enforcement would explicitly have the legal authority to cooperate with federal immigration officials if they so choose — even in sanctuary jurisdictions.

This legislation was introduced in conjunction with Kate's Law, which is named for Kate Steinle, a woman who was murdered in a sanctuary city by an unauthorized immigrant who had been deported five times and had seven felony convictions.

Impact

People who live in sanctuary jurisdictions, law enforcement agencies currently receiving federal funds in those states and localities, the Dept. of Justice, and the Dept. of Homeland Security.

Cost of Senate Bill S. 3100

A CBO cost estimate is unavailable.

More Information

In-Depth: Sponsoring Sen. Pat Toomey (R-PA) introduced this bill to punish sanctuary cities for preventing their law enforcement officers from cooperating with federal immigration officials:
"It is past time to act. This Friday will mark one year since Kate Steinle was gunned down by a repeat felon who was in the country illegally, and she died in her father's arms. I cannot imagine the pain that Kate's father must feel. Sadly, the Steinle family is not alone. The Obama administration has confirmed that sanctuary cities result in thousands of criminals being put back on the streets."

The Obama administration threatened to veto an earlier version of this legislation if it were to pass through Congress and arrive at his desk to be signed into law.

A Rasmussen poll released on July 10, 2015 found that 62 percent of Americans believe the Dept. of Justice (DOJ) should take legal action against sanctuary cities, while 58 percent believe federal funding should be cut off to those cities.

Of Note: Sanctuary cities in particular have long been
controversial and grew in popularity during the 2000s — reaching a total of more than 200 cities or states with variations of the policy.

They re-emerged in the news cycle in July 2015 in San Francisco after Kate Steinle's  murder. San Francisco has been a sanctuary city since 1989, when an ordinance preventing local authorities from assisting federal immigration enforcement was passed. Learn more about the incident, the politics of the situation, and how immigration cases have been handled in San Francisco here.

The federal government has also expressed frustration with the sanctuary cities, as ICE officials are put in greater danger by having to apprehend the undocumented immigrants at their home than if they had been able to pick them up at the jail. Recently the agency has begun tracking the number of “detainer” requests they have sent to local authorities about immigrants they’ve arrest which are subsequently refused, and the subject of the request allowed to go free.

However, the Director of ICE has expressed skepticism that forcing sanctuary cities or states to cooperate with federal immigration enforcement would be helpful, calling it a “highly counterproductive step” that would “lead to more resistance and less cooperation.”

Official Title

Don't just stop with federal funding but impeach the representatives of these states. They are not working for the constitution, they work against individual right. They are working for the UN. California is an example of how the communist, NWO, has highjack and continues to infiltrate our country with non vetted refugees. Through the Wilson Fish act every state is prey, endangered to losing its sovereignty. Tennessee is the first to start legal proceedings and hopefully the other states that opted out of the refugee resettlement will join the suit. Raising awareness of what is really going on,a fight against the takeover globalism. Communism needs to be dealt with and traitors need to be exposed for the treason they are perpetrating against individual rights, against the Constitution of The United States of America.

If you provided refuge for a fugitive, you would be a criminal yourself. Cities should be penalized for doing the same.

One of the many arguments being used here is that it's the city's decision to become a sanctuary city, which is completely true. Any city can decide to be in defiance of federal law whenever it wants, they just won't be funded by those who put the laws in place to break them. Federal funding isn't a city's "right", it's the reward for upholding federal regulations and laws, and should be thus used for the purpose of doing such, instead of drastically and illegally opposing the federal laws that give them those very funds. This isn't true only for this situation either, federal funding should be cut from any state or city that defies federal laws of any kind. If you want something to become legal, make it legal before doing it through due process, otherwise the system will punish you for it.

Immigration officials are manipulated due to the contingency of their actions to abolish the increases of the illegal migration of immigrants exploiting our insecure both southern and northern borders as well. It would be a major disgrace if state local governments were hindering the ability for these individuals to not preform their necessary duties to achieve their task pertaining to their occupation. Illegal immigration is becoming more evident as more time elapsed that we do indeed have A MAJOR PROBLEM THAT MUST BE ALLEVIATED NOT ONLY TO COMBAT ILLEGAL ALIENS BUT RADICAL JIHADIST THAT ARE TRYING TO IDENTIFY WAYS TO DEMONIZE OUR NATIONAL SECURITY AS WELL. If states refuse to not cooperate with the rule of law then there most certainly deserves to be a temporary consequence until our state governments have found common ground with our border security. ITS SIMPLE MATH! This proposal is urgent to pass because it's a implementation to ensure that we have cooperation with all state governments scattered throughout the United States to combat radical terrorist exploiting our borders and the escalation of illegal immigration! Although, when spectating house legislation I notice a Particular side of the aisle that seems to not typically respect the rule of law, not ensure our national security, and not take state action to combat radical jihadist and illegal aliens from exploiting our borders. This would exemplify incompetence on the behalf of the aisle that encourages harsh amnesty for violations of our federal law. The other side of the aisle has to comprehend the urgency in this scenario because their hesitation to ensure our national security for the sake of the American people is beginning to guide state governments to conduct the same disgraceful mindset as well. Thank you for your time.

Are we not a nation of laws? Do only conservatives believe in the rule of law? Do we demand that our government follow laws that they expect we the people follow? If people don't follow laws there are consequences, the same should be true to Cities that do the same, since they don't follow the law the should have a consequence and lose funding.

Like them or not, people need to obey the laws. If you break the law, you are punished. This is what makes us "civilized." We need to realize the importance of self-discipline and respect for the laws, even if we disagree with them.

Too much taxpayers' money is in the hands of the federal government. No city or state should need to seek funds from D.C. However, that being the case now, stop cities from hiding invaders to this country.

These so called sanctuary cities are outside of the law and as their mayors, city council members and chieves of police are sworn to uphold the law and defend the both the national and respective state constitutions they should be subject to arrest and charged criminally in court!

Yes, they should be held accountable! They can only hold out for awhile, till they come to there senses. Those states that have those sanctuary cities I will not visit, like California. They are not safe. Hurt them in the pocketbook, they will come around. Lock up those that don't want to comply with the Presidents orders, period, no excuse!
