senate Bill S. 2785

Should Foreign Nationals Who Interfered or Seek to Interfere With Elections be Prohibited From Entering the U.S.?

Argument in favor

This commonsense, bipartisan bill would deter foreign nationals from improperly interfering in American elections by making them ineligible for admission to the U.S. if they meddle.

Why does congress waste time on simple things like this? Is it so they can say they passed more bills? If someone interferes in an election than there is a motive to harm the US, what do you think they would want to do if they gained entry to the US? Get back to work and impeach the lunatic!!!!

Of course they should. Protecting our own elections from foreign interference is basic.

Argument opposed

Sanctioning individuals who meddle in U.S. elections and preventing them from entering the country is only a weak deterrent given that most will never even attempt to come here.

This seems like a misguided attempt to make the American people feel that Congress is actually doing something about the Russian hacking of the 2016 Elections. We need sanction and prosecution, not meaningless laws that can't or won't be enforced.

We routinely interfere in other countries elections continually, we don't really get to cry foul now just because they picked the wrong (from your perspective) candidate.

Waste of money. You will never prosecute and it has no teeth. You want to do something meaningful, people need to show id before they vote. We need id for almost everything else we do. That includes buy a phone. Anyone with a phone has id. That is what you do if you actually want to protect the ballot box.

What is Senate Bill S. 2785?

This bill — known as the DETER Act — would make foreign nationals seeking to engage in, or who have engaged in, improper interference in a U.S. election inadmissible. Improper interference in an election would defined as conduct that: 1) violates federal criminal, voting rights, or campaign finance law, or is under the direction of a foreign government; 2) interferes with any general or primary federal, state, or local election or caucus, including a candidate’s campaign or a ballot measure.

The bill’s full title is the Defending Elections against Trolls from Enemy Regimes (DETER) Act.

Impact

Individuals who meddle in U.S. elections; and federal agencies.

Cost of Senate Bill S. 2785

A CBO cost estimate is unavailable.

More Information

In-DepthSponsoring Sen. Dick Durbin (D-IL) introduced this bill to deter foreign regimes from interfering in American elections by barring individuals who meddle from admission to the U.S.:

“In 2016, Russia committed an act of cyber war against our country and Congress has a responsibility to take immediate action to prevent Russia’s efforts to influence and disrupt the 2018 elections. The bipartisan DETER Act would prohibit foreigners who improperly interfere in our elections from coming to the United States to further their schemes, and bar them from entering our country in the future.”

Original cosponsor Sen. Lindsey Graham (R-SC) added:

“As we saw in the 2016 elections, Vladimir Putin’s Russia is attempting to strike at the very heart of the democratic values, freedoms, and liberty all Americans hold dear. By barring foreigners who improperly interfere in our elections from coming to the United States, the DETER Act sends a message to hostile nations across the world that the United States will not tolerate foreign interference in our elections.”

Graham is the bill’s lone cosponsor.

Of course foreign nationals who interfere or try to interfere with elections should not be allowed to enter the US. At the same time US citizens who cooperate with these actions should be arrested for treason and place on trial.

Yes, meddling with a country's democratic election IS AN ACT OF POLITICAL TERRORISM. Anybody engaged in such an activity must be viewed as enemy of the people and be banned.

Foreign people who are known to have interfered in the functioning of our government in anyway, especially our elections, shouldn't be allowed in this country.

Foreign Nationals are not citizens and “any involvement” in our election process should be grounds for returning them and their children to their home country. No separating the children, no concentration camps, but send them home and make this clearly known upon arrival.

Yes, But also add a clause that states that any American Citizen who interferes with an election at any level, shall be forced to exit the United States and also relinquish their citizenship. This would include any entity, politicians, religious entities, law enforcement, judiciary and presidents. They must also be forced into imprisonment for one year on the “plastic island” in the Pacific Ocean.
