house Bill H. Res. 646

Supporting the President’s Executive Orders on Immigration

Argument in favor

President Obama didn’t overstep his authority by issuing an executive order to implement the Deferred Action for Parents of Americans program. The House is entitled to express and rally support for comprehensive immigration reform.

“I believe that we have got to pass comprehensive immigration reform, something that I strongly supported. I believe that we have got to move toward a path toward citizenship. I agree with President Obama who used executive orders to protect families because the Congress, the House was unable or refused to act. And in fact I would go further….” [washingtonpost.com]

"I continue to believe that the best way to solve this problem is by working together to pass that kind of common sense law. Because the President can't get anything done without executive orders which is completely unacceptable and there needs to be a better system in place.

Argument opposed

The President’s executive orders on immigration violated both his authority under the Constitution and requirements for implementing regulations. Congress needs to fight back against executive overreach when it occurs, not encourage it.

What is House Bill H. Res. 646?

This resolution would express that the House of Representatives supports the position of the Obama administration in the Supreme Court case United States v. Texas. The Court heard oral arguments in the case on April 18, 2016, which deals with whether the administration’s Deferred Action for Parents of Americans (DAPA) program is constitutional.

The authors of this legislation believe that it is constitutionally authorized by existing laws and administrative actions taken by previous administrations. Opponents feel that the administration violates the Take Care Clause of the Constitution and should not be supported.

As a simple resolution, this legislation would neither advance to the Senate nor have the force of law if it were to be passed.

Impact

Congressional supporters of DAPA; supporters and critics of DAPA; the Obama administration; and the Supreme Court.

Cost of House Bill H. Res. 646

A CBO cost estimate is unavailable.

More Information

In-Depth: Sponsoring Rep. Zoe Lofgren (D-CA) issued an optimistic statement about the fate of DAPA after the Supreme Court heard oral arguments in U.S. v. Texas:

“I left feeling hopeful that the Court will find President Obama’s executive immigration actions legal and a common-sense exercise of executive discretion. They are strongly rooted in precedent and statutory constitutional authority.”

The House of Representatives filed a collective amicus curiae brief with the Court opposing the Obama administration’s position on this case, a move approved in a 234-186 vote.

A total of 15 House Democrats have signed on to support this resolution as cosponsors.

Of Note: Following the decision of a U.S. District Court to issue an injunction blocking DAPA’s implementation, and the Obama administration unsuccessfully appealed to lift the injunction through the Fifth Circuit Court of Appeals. The White House believes that it has the prosecutorial discretion to stop deportations and offer legal resident status to unauthorized immigrants.

The Migration Policy Institute estimates that as many as 5.2 million unauthorized immigrants may be eligible for either DAPA or DACA, which is a similar program focused on unauthorized immigrants who were brought to the U.S. as children.

Yeah, WHEN HELL FREEZES OVER! Obama has thumbed his nose at our Constitution and our very Republic system of government and is endangering our national security, public health and safety, and the American economy through his reckless and illegal disregard for our immigration laws! He defies the courts and takes punitive action against the states that oppose his agendas. And I say "SHAME ON CONGRESS FOR YOUR HISTORY OF CAVING TO THE DEMANDS OF THIS LAWLESS PRESIDENT!" America has always welcomed those who come to our country LEGALLY! Illegal aliens are criminals who have no respect for our laws. Absurdly, they are being treated like victims and given help often denied to American CITIZENS! Why isn't Congress fed up with the injustice of the Obama Administration?! Unfortunately, he can still do a great deal of damage to the American way of life during his remaining months in office, UNLESS CONGRESS TAKES A STAND AND SAYS "NO MORE!" Ideally, Congress should impeach and convict Barack Hussein Obama. IMHO, he belongs in prison, along with Hillary Rodham Clinton! THIS IS THE IMMIGRATION REFORM AMERICA NEEDS: 1. Make E-Verify mandatory for all U.S. employers to eliminate the jobs magnet. 2. Complete the Congressionally-mandated biometric entry/exit system to track non-immigrant visitors to the U.S. 3. End the practice of birthright citizenship for illegal aliens and foreign visitors. 4. Require state and local law enforcement to report affirmatively all non-citizens in custody to ICE, make ICE detainers mandatory, and require ICE to pick up and remove deportable aliens. 5. Expand expedited removal to include all illegal aliens with criminal convictions. 6. End catch-and-release of illegal aliens by requiring that they be detained until removal. 7. Deny immigrant and nonimmigrant visas to nations that refuse to repatriate their citizens. 8. Reform the judicial process in immigration courts, including restricting relief from removal, to expedite the process and reduce the backlog of cases. 9. Restrict asylum to the internationally recognized definition of those who are unable to be returned to the home country due to a well-founded fear of (state) persecution due to race, religion, nationality, membership in a particular social group, or political opinion. 10. Allow Border Patrol access to all federal lands. Please sign the petition now and start applying pressure now fro the next Congress to fix our BROKEN IMMIGRATION ENFORCEMENT SYSTEM! Politicians require you to hate and blame people for everything. That keeps them in office and diverts your attention. It works well and now Trump takes hate and fear to a new level and adds the required fear of other. Will Americans buy the crap he is selling. Trump taking Republican political dogma to a new level.

The Obama Administration has not only manipulated the nations security and safety but it's manipulated congress as well. The Obama administration has granted amnesty to an abundant amount of illegal immigrants that cheat and devalue our comprehensive system EVERY SINGLE DAY. ITS ACTUALLY SCARY! If Barack Obama has implemented these executive orders exploiting our safety and our national security, he is simply exemplifying himself as a truly cold hearted individual for our nations national security. When you steal gum or a tooth brush, or any object with low value from a convenience store, you are read your Miranda rights and before you know it possibly behind bars. However, if you commit (((A FEDERAL LAW))) by climbing over a national border you are immediately granted amnesty by the federal left wing government like you never committed anything what so ever. There is something very wrong here. So I guess if you climb over a fence and yes portions of our border is completely disgraceful, and commit a federal law you are granted amnesty. So if I steal a toothbrush I should be granted amnesty to, I MEAN IT THE SAME PRINCIPLE (and I'm not saying to commit a crime it just dose not make sense). The point being is, our legislative branch establishes laws that are practically overturned by the executive branch (Obama Administration) that results in a fiasco of protecting our nation regarding national security. In other words, we have immigration laws that are not enforced and that is not okay. A large portion of illegal immigrants are just pouring into our nation and committing crimes. I'm sure you are aware that we Americans are paying our tax dollars for these criminals to be held in our federal prisons!! ITS A DISGRACE AND A COMPLETE EMBARRASSMENT THAT MAKES OUR FEDERAL GOVERNMENT LOOK FOOLISH AND MAKE US CITIZENS LOOK FOOLISH AS WELL NOT TRYING TO MAKE A CHANGE. We cannot afford this unorganized mess anymore. In this election our commander in Chief must bring new legislation to Washington to greatly influence and stabilize our immigration policies AND GET TO THE BOTTOM OF THIS. For those truly cooperative legal immigrants reading this. I truly respect of how you understand the proper steps of claiming citizenship for your self. And I'm sorry you have to wait years to get your citizenship in a legal matter and have to wait years while you watch illegal immigrants get their citizenship once they have a child. ITS NOT FAIR TO YOU! THE ISSUE WILL BE DIFFUSED. Let's bring new legislation to Washington in which our immigration laws are stabilized to STOP ILLEGAL IMMIGRATION. As citizens Let's encourage legal immigration and oppose illegal and typical left-wing amnesty! SPREAD THE WORD FOLKS

Let's find a path to legal status and stop treating these families as criminals. We're all immigrants and nobody came here "legally". In fact we owe reparations to Native Americans and American victims of the slave trade. Money will never repair the great loss, but it's a step in the right direction to reconciliation.

Coming from a "Bordertown" (McAllen,TX), I know first hand that the majority of immigrants have no agenda beyond a life of dignity and supporting their families. Many, if not all, consider the American Dream their own. PS: Don't assume I'm not an American citizen because of my name..

Not a chance. Constitutionality is a virtue that should always be honored. Any legislation otherwise is shameful, at best and dangerous, borderline treasonous at worst.
