What is it?

This bill — the Make Sanctuary Cities Pay for the Wall Act of 2018 — would withhold certain federal grants from “sanctuary” state and local governments which refuse to share information with federal immigration officials and redirect that funding to pay for the construction of a border wall on America’s southern border. Withheld funding would be deposited into a wall account administered by the Dept. of Homeland Security (DHS).

DHS would be:

  • Allowed to decline to transfer an unauthorized immigrant to a sanctuary jurisdiction regardless of whether the jurisdiction has issued a writ or warrant;

  • Prohibited from transferring an unauthorized immigrant under a final order of removal to a sanctuary jurisdiction;

  • Required to determine which political subdivisions or states are sanctuary jurisdictions each year and report that information to Congress.

Affected grants would include those made under the Public Works and Economic Development Act and the Housing and Community Development Act.

Impact

The general public; unauthorized immigrants; sanctuary jurisdictions; and DHS.

Cost

A CBO cost estimate is unavailable.

More Information

In-Depth: Sponsoring Rep. Robert Pittenger (R-NC) introduced this bill to defund sanctuary jurisdictions and use the withheld money to pay for construction of the border wall:

“With well over 300 sanctuary cities across the country, it is past time for Congress to take decisive action. Sanctuary cities blatantly subvert the rule of law, incentivize further illegal immigration and endanger law-abiding citizens. All the while, criminals and drugs flow across our porous southern border, bringing violence and crime into our towns and communities. This poses a critical threat to public safety and America’s national security as we know that Hezbollah and other terrorist organizations are actively operating in Latin America… By simultaneously defunding sanctuary cities and funding construction of a border wall, this legislation offers a comprehensive solution to one of our nation’s most pressing and persistent problems.”

This legislation has been endorsed by the Federation for American Immigration Reform (FAIR) and NumbersUSA.

Official Title

    We shouldn’t waste taxpayer dollars on building a ridiculously expensive wall. We could use the money instead on something useful like infrastructure.

    This is childish, racist, and vindictive. Politicians need to grow the hell up. States should have the rights to do what they want and a “wall” is stupid and useless.

    # 1. NO MONEY FOR THAT STUPID WALL. # 2. DO NOT TAKE MONEY FROM SANCTUARY CITIES. This is a ridiculous way to work on immigration. This country is a country of immigrants. My family came in 1620. - we were immigrants. Trump is only a 3rd génération immigrant & his wife MELANIA IS A FIRST GENERATION IMMIGRANT What’s WORSE: The feds lost — yes, lost — 1,475 migrant children who were taken away from their parents because of Jeff Sessions horrible rules.

    Are we on this issue again? No, funds should not be withheld from sanctuary cities and money should not be going to a wall. If you withhold funds from the city’s then the cities and the people living in those cities should withhold federal taxes being paid to the government. If the citizens of those cities within the United States are being singled out and loosing funds for schools, repairs on infrastructure, and other such federally funded issues then why should we pay more in taxes? There is a wall already in place. Stop being so scared, racists and bigoted regarding an issue that has shown to not be as big as an issue as you are making it.

    There should be no funding for Trump’s stupid wall! If Trump wants to build it, it should come out of his own pocket. The GOP and this administration’s obsession with sanctuary cities is absurd. Immigrants are less likely to commit crimes than American citizens.

    Critical community funding should not be withheld for failing to enforce racist laws which disproportionately affect minority groups. It is tragic that systemic issues are being blamed on immigrants and that persecuting Latino Americans is the proposed solution to those problems.

    A border wall is a waist of money! Cartels will find other ways to get the drugs over the border, they have for decades & will continue as long as there are US citizens willing to purchase said illegal drugs!

    No wall, not with tax dollars! I don’t know who is the bigger fool, #45, who promised to build The Wall that would be paid for by Mexico or the ones that believed him. Do not withhold the monies to the sanctuary cities. Those cities are well within their rights to offer sanctuary. That #45 doesn’t know this, is no surprise. When you don’t read but Twitter posts in techie shorthand, you miss out on substantial stuff like the rights of states and people!
