Canceling Deportations for Undocumented Parents

Argument in favor

Protects American children from having their parents torn away from them.

···
06/12/2015
We are a country, allegedly build upon the backs and with the strength and love of families. Strengthening families has been one of the great goals of most Americans for a long time. At least since the economy forced most families to send both parents out to earn an income. Perhaps we became greedy ourselves, at least for a while, when mothers joined Dads in an attempt to increase the family income. But one result in that action was finding and demanding that our girls were allowed and encouraged to be educated just like our sons. And now it seems that they do better in academics, statistically and have added so much to our economy. Deporting the parents who worked so hard to educate and raise their children to be good Americans absolutely seems to defeat the purpose we had in mind for FAMILIES. Let us not be racist in our support of our families. Almost regardless of who you are, there was a time when your ancestors were not welcome in this country. WHAT A SHAME! Let's do all we can to change that bad direction. And let's begin with comprehensive changes to our Immigration laws, which will have the effect of improving our educated citizenry, and not in making them take their education, earned in America, back to a land they never knew. Just because somebody wants to get rid of the hard working parents and grandparents who reared them so well.

Anything that reduces mandatory sentencing and gives the power to the courts to make individual decisions in individual cases has my support.

Argument opposed

Gives undocumented immigrants living here illegally a free pass — not based on laws, but on a judge's opinion.

I VOTE NAY! Democrats and open borders advocates are always appealing to your FEELINGS instead of REASONING! Just ask yourself how the children become citizens if the parents are illegal aliens. The United States must END BIRTHRIGHT CITIZENSHIP! I think we're the only country that allows that! This is nothing less than part of the push by the George Soros types to form a North American Union, and I am TOTALLY against it! The United States would cease to be a SOVEREIGN NATION, and you think we have problems now?!! Think of what has happened to the EU!

Nope. They are breaking our law and should be treated as such. Treat then with decency but deport them all who came in illegally instead of waiting in line with the legal immigrants. Obama himself pointed that out by the way.

They need to be deported and their offense needs to be recorded. Undocumented immigrants from all over the world cost the economy way too much money. More than they actually pay in taxes. We are basically paying them to live here.

What is House Bill H.R. 406?

This bill would give immigration judges the power to not deport an undocumented immigrant who has a child/children that are U.S. citizens.

Under H.R. 406, immigration judges can
take family situations into account during deportation proceedings. If they decide that the removal of a parent would go against a child’s best interests, they have the authority not to order a deportation. Currently, under the Immigration and Nationality Act, non-citizens can be subject to deportation for doing most anything, ranging from falsifying documents to "moral turpitude" to being convicted of a felony.

Empowering an immigration judge's discretion has its limits under this bill though — deportations would be mandatory if the undocumented parent is to be deported for security reasons or has engaged in sex/human trafficking.

Impact

Undocumented immigrants, U.S. minors with undocumented parents, federal judges.

Cost of House Bill H.R. 406

A CBO cost estimate is unavailable.

More Information

In Depth:

In 2011, an estimated 3.1 million U.S. citizen children had one or more undocumented parents. Sponsoring Rep. Jose Serrano (D-NY) noted in favor of his bill:

"I have trouble believing that any American would support their government breaking up families or orphaning children," Serrano said. "We must bring our government's policies in line with our values, which do not include breaking families apart."

To provide discretionary authority to an immigration judge to determine that an alien parent of a United States citizen child should not be ordered removed, deported, or excluded from the United States.

Laws need to be followed. I know there are sad situations. People who break the law still need to pay the consequences. People commit crimes that lead to prison time and it destroys their families too. It doesn't mean the get to commit crimes and have no consequences.

I understand that this great country was built partially of the backs of immigrants who where looking for a better life but you have to understand that my ancestors where nearly whipped out because of it I think borders need to be closed until some type of order is in place / Look I'm quarter Indian quarter English quarter Irish quarter dick and all asshole and i could qualify for the Indian treaty act but I don't because I'm not full Indian and it wouldn't be right to take away benefits form those who need it. It's not there fault that some where down the line some dick heads decided to abduct an rape some Indian women. We need to get our shit together before we move forward on letting any more people in this country

These parents knew they were breaking the law. If it was important their is always the right option. These children should not automatically be American citizens. At some point as a Nation fighting for its survival it must be understood that personal responsibility belongs to the illegals. Our responsibility is to our nations laws. Our only responsibility is to America and her ppl. Free will the right to choose, legally or illegal, front door or back door? If back door then don't let the door hit you where the good Lord split you.
