house Bill H.R. 1397

Should ICE Be Notified When an Unauthorized Immigrant Attempts to Purchase a Gun?

Argument in favor

It makes sense for ICE to be notified when unauthorized immigrants are denied gun purchases due to their immigration status. This will help enforce both immigration and control laws.

Sounds rather obvious that if an illegal alien is purchasing a gun ICE should be called.

They aren’t citizens, & aren’t here legally. They shouldn’t be allowed to purchase guns. I love how the people that cry for strict gun control for actual citizens are the same ones saying “No” to this. Once again putting illegals far above actual Americans. I wouldn’t expect anything less though. Hypocrisy is a cornerstone of the moronic far left.

Shouldn’t authorities be notified when ANYBODY tries to buy a gun?

Argument opposed

Reporting unauthorized immigrants to ICE shouldn’t be one of firearms sellers’ responsibilities. Immigration enforcement belongs with federal agencies, not with private citizens.

Why isn’t anyone notified when a mentally ill white person purchases a gun? Last I checked “illegal immigrants” aren’t the ones causing mass murders

How about those universal background checks that 80+% of Americans want? Or the National Weapons Registration Databank? There are a dozen better ideas in gun safety that are not racist false flags to stir up the xenophobics and the ignorant.

What stable genius thought this up? You already have to be a citizen or permanent resident to legally purchase a gun in the US. Gun shop owners know their jobs and don’t need more regulations placed on them. ICE should get the same notification every other law enforcement agency gets when anyone who shouldn’t be buying a gun tries to buy a gun. Should ICE get a special report? No. Should ICE get a report based on racial profiling? No Are undocumented immigrants going to line up to fill out the paperwork required to purchase a gun in a store? No. If someone wants to buy a gun regardless of immigration status they can do so without going through a background check in most every state in the Union. Pass the Bipartisan Background Check Bill not some stand alone partisan grandstanding effort that is already included in the larger bill.

Yeah if an illegal immigrant is dumb enough go buy a gun legally, then yes ICE and the local police (who should be cooperating with ICE) should be called this way the person can be arrested and held until ICE can arrive to send them back to wherever they came from with a one way ticket. Yes, of course. Native born citizens have requirements regarding buying firearms. Unauthorized immigrants must be more highly vetted in buying firearms. Unfortunately we know there are a lot of under the table purchases that occur that are not easily tracked. But yes, ICE should know and this could be a factor for deportation or jail.

Why do we need a new bill on firearm rejection? Details of this bill mentioned that rejection is common with illegals, so other agencies should already have access.

How about a National Weapons Registration Database Instead, so all weapons are traced to the source of their manufacturers, distributors, owners, and disposition. Then you can track all the uses of these weapons for legal and illegal use.

What is this freaking obsession with Immigrants as "The Big Bad"?....Haven't most of the attacks by gunmen been perpetrated by white American's? Yes, we need to revamp our gun laws but STOP this Trumpian scenario of Immigrants being the boogieman.

Authorities should be notified when domestic violence abusers try to buy one. That's where the most people are killed. We need to clean up our own house more than anything else. No objection to that of immigrants if we've addresses our own home/grown terrorists. Why isn't anything being done about them?

#1 this is not needed as a stand alone bill, since it is already part of the one they SHOULD pass. #2 this only requires NCIS/FBI notification of ICE. This is only a first step. I support notification of state, county, and local law enforcement agencies as well. I also support notification of an attempt to purchase, successful or not, when the person is a citizen who is mentally ill or impaired. #3 more people should take time to read and understand the FULL description presented by this site. These people do good work, and it goes to waste if you react without the complete information presented.

Crazy questions. Seems like the left wants to protect non-citizens from repercussions of all illegal acts. In other words come into our country and commit any crime and we will welcome and protect you . On the other hand if you are a citizen, we will arrest, fine and jail you; and try to prohibit you from buying that gun. I wish there was a fair way to just prohibit really mentally ill people from having guns. The sad truth is the stronger those laws the more likely the government will abuse them and use them against ordinary citizens that should be allowed to own guns. There are no easy answers because the bigger the government gets the more corruption.

Yes, any time an undocumented immigrant tries to buy a gun and is rejected by the instant background check this information should be shared with ICE. This is not a communication that involves either the gun dealer or the customer. (When a NICS denial of purchase is received by the dealer, no information is given other than that the purchase was denied.) The bill, H.R. 1397, simply sends a record of the denial from the NICS system (located in the FBI) to the ICE immigration data system. The National Instant Check System is administered by the FBI because gun buyer background checks have been based mainly on criminal record data that the FBI oversees. Immigration status information is collected and used by ICE. (It is telling that in a post-9/11 world the Democrats have actually refused to allow this simple, commonsense interagency background check information sharing provision to be amended to their own “Universal Background Check” bill. That bill, H.R. 8, claims to provide background checks for all gun buyers, but the wording seems intended to force all private owner-to-owner gun transfers to go through dealers [for a fee] and also to remove the current requirement that if a background check is delayed for further investigation it be resolved in a timely manner. At the same time, there is nothing in the bill that would prohibit persons in the US illegally from buying guns, that would apply specifically to persons prohibited from owning a gun, nor that could keep the very people from whom it claims to protect us from choosing to ignore the procedure completely — which is exactly how prohibited persons get guns now.) Yes, any time an undocumented immigrant tries to buy a gun and is rejected by the instant background check this information should be shared with ICE. This ought to be a no-brainer. Since the Democrats are so focused on exempting illegal aliens from the burdens of American law I hope you will support support Representative Ben Cline’s bill, The Notify ICE Act (H.R. 1397), with your advocacy and your vote.

So this is under the guise of our safety but really just another RACIST IDEA to harass and attack immigrants. Where is this idea WHEN WHITE CRIMINALS OR TERRORISTS buy guns? Where is this idea when WHITE PEOPLE WITH MENTAL HEALTH ISSUES buy guns? Where is this idea when WHITE TEENAGERS buy guns? Where is this idea when WHITE MEN INVOLVED IN DOMESTIC VIOLENCE buy a gun? Call this what it is RACIST AND XENOPHOBIC!!! White people with guns tend to be the problem when it comes to mass shootings, not immigrants.

Well, first, ICE should be disbanded. Secondly, this is just more racist fearmongering from the Republican Party rather than a legitimate attempt to solve any actual problems. What about universal background checks? What about a national registry? What about waiting periods? There are ways to respond to gun massacres. We haven’t done any of them.
