Top Judges Rejected Gerrymandered Election Map; Now They Face Impeachment

What’s the story?

GOP lawmakers in Pennsylvania aren’t going down without a fight. First, the state Supreme Court struck down the congressional district map as a partisan gerrymander. Then the U.S. Supreme Court refused to take up the case and challenge the state ruling. Now, GOP lawmakers have introduced legislation to impeach the justices who issued the state ruling.

GOP State Rep. Cris Dush said in February that the justices should be impeached, but he waited until the U.S. Supreme Court decision was handed down to formally introduce legislation calling for impeachment. He had hoped to include text from a SCOTUS decision in his favor.

Still, he’s forging ahead. According to The Hill, Dush has "introduced resolutions to impeach four of the five state Supreme Court justices who voted to override congressional district maps", accusing them of “misbehavior in office”.

A fifth resolution for the fifth justice who voted to strike down the maps is pending introduction.

Only one Pennsylvania Supreme Court Justice, an elected office, has ever been impeached. Justice Rolf Larsen was impeached in 1994 following conviction on two counts of conspiracy.

With only Republican support, Dush could achieve impeachment of all five justices. The state House has the sole power to impeach justices. Republicans currently control 120 of 203 state House seats. Actually removing justices would require a two-thirds vote in the state Senate, and Republicans control 34 of the 50 state Senate seats.

    This is tyranny at work... plain and simple. Getting rid of judges that don’t agree with you and replacing them with judges that do is an earmark of tyranny.

    How about we impeach these petulant little children that we call our representatives? These GOP reps lost their fight and instead sitting down and taking the loss like adults, they now want to remove the people who enforce the laws on the books. Vote these clowns out in November! All of them!

    I guess if you can't win honestly, you have to break the law. Redraw the lines and run good candidates. Every state should redraw the lines and stop cheating to win.

    I do not think that the PA Supreme Court justices have done anything to be punished with impeachment. I will stand by what I said when this issue first came to light a while back, the GOP sees a political obstacle, not a constitutional danger and they believe that they can remove the obstacle rather than allow the courts to do the job that it they were created for in the first place.

    I don’t think impeaching a state Supreme Court judge because they don’t rule in your favor as democracy. The GOP can’t be allowed to get away with this, this goes against what our country is founded on.

    OF COURSE. THE REPUBLICANS ARE WHO DID THE GERRYMANDERING. THEY ARE TRYING TO PROTECT THEIR MINORITY DICTATORSHIP. STAY OUT OF IT!!!! The courts are supposed to be the check on the rest of the government

    The call to impeach the Pennsylvania Supreme Court Justices is a tantrum by Republicans who are sad because fair districts mean they lose control and have to allow the people of the state to choose their representatives. The Court was forced to act since the Republican controlled legislature was operating in bad faith. I am a Pennsylvania voter and there is a push to get an amendment to the State constitution to have the district lines drawn by an independent citizens committee after the next census. No one party should be able to avoid running good candidates and be confident of a win. Districts need to make sense.

    This is completely disgusting. This a total abuse of the power of impeachment and is tyranny at its finest. We have multiple layers of checks of powers in our systems of governments. The justices used their power of judicial review to overrule the unjust and unconstitutionality of the gerrymandered district map. Now the majority in both chambers can simply seek revenge and impeach these officials on no good grounds except partisan bickering?! They are the ones who should be impeached. I just hope Pennsylvania has some good hearted senators and representatives that respect the courts influence and democracy itself. Therefore I hope they won’t vote for impeachment and conviction.

    When I saw a map of how the districts had been redrawn by the Republicans, I was shocked. To call for impeachment of the judges is unbelievable. We have a system of checks and balances for a reason. The judges were doing their job.

    What used to be unthinkable is now normal. Impeaching judges because you disagree with them is horrific in a constitutional democracy. Shame on those who support this.
