Appeals Court Upholds Ohio Law Blocking Public Funds for Abortion Providers

The Sixth Circuit Court of Appeals issued an 11-6 opinion on Tuesday which upheld an Ohio law that prohibits abortion providers from receiving taxpayer funds through the state’s public health programs.

Planned Parenthood challenged the law, arguing that it unduly infringed on womens’ right to obtain abortions by requiring it to stop performing abortions to continue receiving state funds. By upholding Ohio’s law, the full Sixth Circuit Court reversed rulings made by a district court and a three judge panel of the Sixth Circuit that were in favor of Planned Parenthood’s position.

Judge Jeffrey Sutton wrote in the majority opinion that the law “will not create an undue burden on a woman’s right to an abortion” and explained:

“Private organizations do not have a constitutional right to obtain governmental funding to support their activities. Just as it has no obligation to provide a platform for an individual’s free speech, say a Speaker’s Corner in downtown Columbus, it has no obligation to pay for a woman’s abortion. Case after case establishes that a government may refuse to subsidize abortion services.”

Planned Parenthood didn’t indicate whether it plans to appeal the ruling to the Supreme Court.

Last week the Senate confirmed two judges to the Sixth Circuit ― Eric Murphy and Chad Readler ― but they weren’t involved in this ruling. Their predecessors, Judge Alice Batchelder and Judge Deborah Cook, joined the majority’s opinion.

    The government should let me and other women choose how they want healthcare over their own bodies. I don’t ask the government about men’s choice to reproductive rights why should they regulate woman’s reproductive rights. The more free contraceptives the less abortions. Come on people. It should be a case by case basis between a doctor and a patient. Please stop giving rights to government to make personal decisions of woman’s rights.

    Planned Parenthood doesn't only offer abortion services; it also offers mammograms, gynecological exams, etc. Those are needed by all women. Refusing funds to PP because it offers abortions is hypocritical. The US government and evangelical "Christians" think nothing of invading other countries and murdering innocent adults and children by bombing the bejeezus out of them because their country has resources we depend on, they're of a different religion, or the US government has decided it doesn't like the leader of that country anymore. If abortion is murder, then what is invading another country and bombing it, resulting in the deaths of 1000s of people? What do you call separating migrant families at the border, resulting in the deaths of some of those adults and children by offering inadequate, if any at all, medical care, to them? Enough of the hypocrisy!

    I’ve said this before and I’ll say it again: the government shouldn’t intervene on this issue. This is a very divisive ethical issue that should be decided by the people, not the government.

    They have such nerve, essentially banning abortion, while at the same time restricting meaningful sex education and interfering with a woman's right to birth control. I don't understand why the AMA doesn't protest these laws, since they interfere with a doctor's obligation to his patients.

    Funds do not go to abortions. Funds go to Planned Parenthood to support exams and other lifesaving tests for women who otherwise can’t afford cancer screenings.

    I think if my tax dollars can't go to pay to help a woman in time of need, then I also want my tax dollars to stop helping the pay the pentagon's several million dollar a year Viagra bill as well please.

They diagnose for STDS, they offer affordable birth control. Mammograms, cancer screening, affordable yearly pap smear screening. They are counselors, educators ! STOP the damn judgment, spreading misinformation! Learn to separate fact from fiction! They AGAIN, DO PAY FOR ABORTIONS!

    People need to mind their own business and not force their flavor of the week religious dogma on others. Civil law is not necessary “God” law. The religionists need to render unto Caesar unto Caesar and God unto god. Keep civil law civil.

    Abortion is not the problem. Unwanted pregnancies are the problem. If you want to end abortion educate educate educate males and females on their choices and consequences of their decisions before they make the decision to have unprotected sex. Make birth control free for women. Studies show that given the choice of birth control methods women will choose the ones that will last the longest including implants. Research and develop male contraceptives. Moral education if that is what you believe in. And if you are truly right to life then there should be right to life adoption agencies and right to life Fanatics lining up to adopt these children that are unwanted and forced to be born. End the hypocrisy. You cannot stop caring about these lives once they begin. Once again the only way to end abortion is to prevent unwanted pregnancies. It is a simple problem with a simple solution. Don't legislate against abortion since there are cases when they are needed legislate for pregnancy prevention weather physical or moral and step up and adopt the children that are born that are not wanted. I have never heard of a pro-life adoption agency anywhere. Don't just make it so that these children are born make it so that these children are cared for after they are born.

    We give all kinds of tax money to corporations that pollute the environment, tax monies to corporations that make millions of public transportation, tax monies to defend countries that are against us, tax breaks to organizations that support child bearing even though they know those individuals can not afford children let alone themselves. But a company that provides way more Women’s support other than just abortions you want to give no tax support. How many of these so called righteous give money or volunteer support to this agency to help reduce or eliminate abortions. Nothing but whining to your grand Uncle.

    Stop trying to restrict Women's rights and health issues. If you are a man it is none of your business and if you are a women and do not believe in abortions___don't get one. You have no right to force your beliefs on others in this country. The US Constitution is not the Bible but it is the law of the land.

    This is just another step in the Repugnants decision to treat women as second class citizens. NO ONE should tell women what medical services they can or cannot have. NO ONE - man or woman has the right to determine what a woman does to or with her body. We are not property. Those days are supposed to be over. If you allow the state of Ohio to get away with this, than how will you face the women of this nation, or the women in your family. Explain to them how Ohio has the right to tell women what they can and cannot do to their own bodies. All that is necessary for the triumph of evil is for good men to do nothing. It's time for good men of conscience to act.
