22 States Sue to Keep Net Neutrality Protections

What’s the story?

Twenty-two state attorneys general have filed lawsuits challenging the FCC’s recent repeal of net neutrality rules.

Why does it matter?

In December, the Federal Communications Commission voted to dismantle net neutrality regulations, allowing internet providers to speed up – or slow down – access to apps and websites.

The lawsuit - which every Democratic AG in the country joined - challenges that the FCC move was "arbitrary, capricious and an abuse of discretion" and violated federal laws and regulations.

"The repeal of net neutrality would turn internet service providers into gatekeepers—allowing them to put profits over consumers while controlling what we see, what we do, and what we say online," said New York Attorney General Eric T. Schneiderman, who is leading the suit.

Mozilla and internet advocacy groups Free Press, Public Knowledge, and New America’s Open Technology Institute filed similar petitions on Tuesday.

FCC spokesman Brian Hart declined to comment on the litigation.

    This should not be a partisan issue. All Americans DESERVE open access to the internet. It has become the newspaper of the 21st century and a major source of information for all. Giving corporations the ability to filter or control the information presented over a connection Americans PAY FOR is akin to censorship. That violates the guarantee of a free and independent press in the Constitution. The FCC repealed this rule in direct conflict with the wishes of the American people it is supposed to serve and protect. Congress has failed to act as they are too busy NOT funding our government or keeping promises made to productive, law-abiding members of our society. I find it deplorable that one has to live in a state served by a Democratic AG to maintain their constitutional rights. Apparently, all Republicans have sold their souls to the devil, not just the ones elected to Congress. If you are not standing up for the 1st Amendment rights of all Americans, you cannot consider yourself an American and should renounce your citizenship. The next step will be the attempt to repeal the 1st Amendment all together. Will THAT wake you up? Do you care? Is that more important than closing the borders or stripping entitlements or breaking promises or starting a nuclear war? Get your heads out of your asses and CHECK THIS ADMINISTRATION.

    Smart move on the local legislation; less they be a part of the 2018 grand exit campaign. However it will NOT negate the people's response come 2018. Make no mistake, we will remember exactly who voted to "roll back" every single constituent focused legislation from the dismantling of education in the Feb 2016 to the yo-yo stance on CHIP.

    There is a reason these rules existed in the first place. It wasn’t to limit the rights of the poor internet service providers, it was to protect the rights of citizens. Net neutrality is there to ensure that censorship of information cannot occur on the internet. It makes the internet a free space that doesn’t allow internet service providers to charge differently or limit access to certain websites or content. How can you possibly be against this? So many of receive information via the internet nowadays. Don’t you want to make sure that the access to that information is fair and unbiased? Do you know what fuels communism and fascism? Limited access to information and the propagation of propaganda.

    You are assuming they will overwhelmingly put profits over consumers and not let us the consumers apply capitalism to regulate innovation and price by giving us the choice. Govt. regulations stifle competition and create a controlled environment of everyone is the same (socialism).

    Net neutrality should ABSOLUTELY be preserved ... this move by Ajit Pai neither benefits, nor is desired by, the vast majority of consumers. This government has shown itself over and over again to be anti-consumer, anti-citizen, pro-big-donors and it has got to stop. Our elected representatives are in place to represent US - not fatten their already-bulging wallets at our expense. #2018willbesoblue

    I agree with any and all attempts to reverse the FCC's ruling on NET NEUTRALITY!! I have already noticed a difference in the slowing down of some of the websites I visit and I want it stopped! So I applaud all the AG's that joined the lawsuit and hope the Senate will follow suit with legislation to reverse the decision as well!

Have you ever wondered, if both the Democrats and the Republicans are against deficits, WHY do we have deficits? Have you ever wondered, if all the politicians are against inflation and high taxes, WHY do we have inflation and high taxes? You and I don't propose a federal budget. The President does. You and I don't have the Constitutional authority to vote on appropriations. The House of Representatives does. You and I don't write the tax code, Congress does. You and I don't set fiscal policy, Congress does. You and I don't control monetary policy, the Federal Reserve Bank does. One hundred senators, 435 congressmen, one President, and nine Supreme Court justices equates to 545 human beings out of the 300 million are directly, legally, morally, and individually responsible for the domestic problems that plague this country. I excluded the members of the Federal Reserve Board because that problem was created by the Congress. In 1913, Congress delegated its Constitutional duty to provide a sound currency to a federally chartered, but private, central bank. I excluded all the special interests and lobbyists for a sound reason. They have no legal authority. They have no ability to coerce a senator, a congressman, or a President to do one cotton-picking thing. I don't care if they offer a politician $1 million dollars in cash. The politician has the power to accept or reject it. No matter what the lobbyist promises, it is the legislator's responsibility to determine how he votes. Those 545 human beings spend much of their energy convincing you that what they did is not their fault. They cooperate in this common con regardless of party. What separates a politician from a normal human being is an excessive amount of gall. No normal human being would have the gall of a Speaker, who stood up and criticized the President for creating deficits.. ( The President can only propose a budget. He cannot force the Congress to accept it.) The Constitution, which is the supreme law of the land, gives sole responsibility to the House of Representatives for originating and approving appropriations and taxes. Who is the speaker of the House?( John Boehner. He is the leader of the majority party. He and fellow House members, not the President, can approve any budget they want. ) If the President vetoes it, they can pass it over his veto if they agree to. [The House has passed a budget but the Senate has not approved a budget in over three years. The President's proposed budgets have gotten almost unanimous rejections in the Senate in that time. ] It seems inconceivable to me that a nation of 300 million cannot replace 545 people who stand convicted -- by present facts -- of incompetence and irresponsibility. I can't think of a single domestic problem that is not traceable directly to those 545 people. When you fully grasp the plain truth that 545 people exercise the power of the federal government, then it must follow that what exists is what they want to exist. If the tax code is unfair, it's because they want it unfair. If the budget is in the red, it's because they want it in the red. If the Army & Marines are in Iraq and Afghanistan it's because they want them in Iraq and Afghanistan .. If they do not receive social security but are on an elite retirement plan not available to the people, it's because they want it that way. There are no insoluble government problems. Do not let these 545 people shift the blame to bureaucrats, whom they hire and whose jobs they can abolish; to lobbyists, whose gifts and advice they can reject; to regulators, to whom they give the power to regulate and from whom they can take this power. Above all, do not let them con you into the belief that there exists disembodied mystical forces like "the economy," "inflation," or "politics" that prevent them from doing what they take an oath to do. Those 545 people, and they alone, are responsible. They, and they alone, have the power. They, and they alone, should be held accountable by the people who are their bosses.     Net neutrality = freedom of speech + freedom from exploitation. As a result of the FCC betraying Americans I hope every municipality creates their own internet utility and puts big cable out of business for good.

    Rob Wittman, Dave Brat, Bobby Scott, Donald McEachin, Mark Warner, Tim Kaine, Barbara Comstock and other Virginia Congress persons should be fighting for Net Neutrality in Congress. If they aren’t, they clearly have failed to represent the will of their constituencies and will continue to draw the ire of Virginians as long as NN is under fire

    The internet is our public utility. Pai may not realize this but the internet is not his to give away to his rich cronies to use to rape obscene profits from the public and to stifle start up and independent businesses. We the people DEMAND net neutrality.

    Re: Donna: I was really digging your piece until you started bashing Republicans. I myself am not a modern day Republican. I believe in the Republican Party of Abraham Lincoln but it hasn’t at all resembled that for quite some time now. I am an American and then I call myself a Constitutional Conservative. I believe in God, country and family. Anyways my point is that both sides of the isle are corrupt and unworthy to represent US, We The People. Yes ma’am it’s mainly Republicans on this issue but the Democrats are responsible for others. I totally agree with you on your stance of the First Amendment. However, do you feel the same way about the Second? How about the Fourth? And even more importantly (in my opinion) the Tenth? Or The Constitution as a whole even? We are not a perfect nation and never will be but WE have the best form of government that ever existed. We govern ourselves through the people that WE send to Washington or at least that’s how it is supposed to work. And they haven’t worked for us for some time now. They serve themselves and each other and they do it for money and political favors.
