16 States Join CA Lawsuit Against Trump’s Emergency Order – Do You Want Your State to Join?

UPDATE - February 19, 2019:

  • A coalition of 16 states - including California, New York, and red-state Maryland - have filed a federal lawsuit to block President Donald Trump's plan to use emergency powers to build a border wall with Mexico.
  • The Center for Biological Diversity, Border Network for Human Rights, and the American Civil Liberties Union have also announced lawsuits.
  • At the center of all the lawsuits is the argument that the Trump administration is circumventing Congress to divert funds for his border wall.
  • California et al. v. Trump et al. says that the plaintiff states are bringing suit to protect their residents, natural resources, and economic interests.
“Contrary to the will of Congress, the president has used the pretext of a manufactured ‘crisis’ of unlawful immigration to declare a national emergency and redirect federal dollars appropriated for drug interdiction, military construction and law enforcement initiatives toward building a wall on the United States-Mexico border,” the lawsuit says.

What’s the story?

  • California has been joined by a number of other blue states in filing a lawsuit against the Trump administration over the president’s declaring of a national emergency to get funding for his proposed border wall with Mexico.
  • The thirteen states suing include New Mexico, Oregon, Minnesota, New Jersey, Hawaii, Connecticut, and Colorado.

What are both sides saying?

  • California Attorney General Xavier Becerra (D) told ABC’s “This Week” that the state is “ prepared. We knew something like this might happen. ... We are ready to go. We're confident there are at least 8 billion ways that we can prove harm. It's become clear that this is not an emergency, not only because no one believes it is, but because Donald Trump himself has said it's not."
  • “Our message back to the White House is simple and clear: California will see you in court,” Becerra said.
  • Judge Jeanine Pirro wrote on Fox News that “Trump’s border emergency shows being a leader means making the tough decisions.”
  • “Being a leader means making tough and many times unpopular decisions. This week, we watched a leader declare a national emergency where one was unequivocally and undoubtedly needed.”
She added: “I can't imagine that the Supreme Court would not support the declaration of an emergency given Congress' repeated failure to act, and the president’s repeated attempts to make the Democrats act.”

    The wall is a waste of money and the “National Emergency” finding being taken from the military construction budget pulls funding from the planned improvements for the Wright Patterson Air Force base which affects the economy of Dayton Ohio. Senator Portman, don’t Sacrifice the Miami Valley for Trumps folly. If you do we will remember where your priorities are during the next election!

    Why isn't Texas apart of this lawsuit? I hate to hear that we the people have come to this. It is a disgrace and ashame that we have sue the POTUS over his ridiculous tantrum he is having because he can't get his way. Childish..I am embarrassed that our President is a child in an adult body. What example and precedent are you setting...a very, very bad and poor example.

    The fake-news president has once again created a fake news story and any representative that doesn't fight back against his power-grab away from congress is now fully responsible for the disaster. Please stop the fake-emergency of wall funding. Stop backing up this idiot. Do your job!

    I only say Maybe because if a President can dictate a national emergency so easily, than it should be restricted to an actual national emergency. I do not believe the southern border problem is an emergency, more so a crisis. This can be solved through Congress on actual immigration reform and better security, not by building walls. However, I believe that if we set a precedent to sue the Presidency, than no President can make a move without the other party saying, “no that does not fit our ideology, we are suing you.” That is a dangerous slope and I wish for both sides to rethink this cliff edge, and California needs to be put in their place if you ask me.

    There is not a National Emergency that warrants building a wall. The Wall is such a stupid idea. If we are serious about immigration, just put some teeth in anyone that hires illegal aliens. If jobs dry up, so does illegal immigration.

    I live in a border state. Unless you have lived here you cannot pretend to know whether this is or is not an emergency. Let all members of Congress come and spend 30 days living in a border town sans security and see how they feel.

    Americans want this wall built, ad I truly believe this is a national emergency. Especially given the fact that Congress cant enact reasonable immigration laws that protect US Citizens. Its time to get something done. We need to stop the bleeding so we can focus on other areas of interest in this Country.
