Do You Support Defending Obamacare Against a Lawsuit?

Should Congress fight to protect the Affordable Care Act?

What’s the story?

  • House Democrats have passed a resolution to defend the Affordable Care Act, or Obamacare, against a lawsuit filed by GOP states. A Texas federal judge ruled in favor of the GOP-led lawsuit, saying the ACA is unconstitutional. The Trump administration has declined to defend the law.
  • This resolution was part of a standalone package, and came a week after the Democrat-controlled House passed a similar measure as part of a rules package. That motion asked the court to allow the House to intervene as a defendant in the case alongside cache of Democratic states.

What’s the backstory?

  • A district judge in Texas ruled last month that because the ACA’s individual mandate is unconstitutional, the entire healthcare law is also illegal. The suit also argued that the law’s protections for people with pre-existing conditions should be overturned.
  • Various states are appealing the ruling. Obamacare will remain in place as the lawsuit makes its way through the legal system.

What does the resolution do?

  • The resolution is largely seen as a way for Democrats to force Republicans to go on the record of whether they support protecting patients with pre-existing conditions.
  • Three GOP congressmen - Reps. Tom Reed (NY), John Katko (NY), and Brian Fitzpatrick (PA) - voted in favor of the resolution.

What are both sides saying?

  • “If you support coverage for pre-existing conditions, you will support this measure to try to protect it. It’s that simple,” said Rules Committee Chairman Jim McGovern (D-MA) before the vote.
  • A majority of Republicans, however, opposed the resolution, arguing it was unnecessary given that the House voted last week to file a motion to intervene.
  • “At best, this proposal is a political exercise intended to allow the majority to reiterate their position on the Affordable Care Act,” said Rep. Tom Cole (R-OK). “At worst, it’s an attempt to pressure the courts, but either way, there’s no real justification for doing what the majority wishes to do today.”

    Healthcare was the top concern of Americans during the midterm elections; specifically, protections patients with preexisting conditions from paying higher premiums. It continues to be the major concern of Americans; only taking a temporary backseat to getting the hundreds of thousands federal employees back to work. The GOP has not provided an acceptable option to replace ACA. As it is, representatives must do everything possible to provide their constituents with all the protections they need. Until Medicare for all is passed, ACA must stay.

    Obamacare raised my premiums. Get rid of Obamacare! It was a Trojan horse to begin with and is still wasting our tax dollars! Free market is the best way to go.

    The Radical Republican Right has tried over 50 times to destroy the ACA, but failed at each attempt. The majority of our citizens (54%) not only want the ACA, but want more government provided healthcare. The Trump/Pence Regime is on a one way trip to self destruction... it’s only a matter of time!

    Far more difficult than defending it against a lawsuit is to try defending it against laws of economics and of morality. Try it in those courts and it comes out looking pitiful.

    The United States needs affordable health care for all citizens. Other civilized countries manage to provide universal coverage, lower costs and better outcomes than we have. It is time to fix the broken health care system. Insurance companies, the pharmaceutical industry and their lobbyists are a big part of of the problem. If the name ACA is holding up progress, change the name and move forward with a plan that protects pre-existing conditions and provides affordable care to all Americans. If this puts for profit insurance companies out of business, oh well.

    The Affordable Health Care Act protects those with pre-existing conditions and those who might otherwise not have health care. This plan should be protected!

    The Democrats are afraid of subsequent law suits showing they illegally pushed this crap through and that they will take a political hit. This is the only reason they are trying to push this. The fact is Obama bin laden LIED to ALL Americans when he said you get to keep your existing health care.     The Affordable Care Act should be defended in court, remain in place as law, be enforced as permitted by law, and enhanced to cover more people, decrease premiums and deductibles

    Obamacare needs to be defended and preserved as an interim step to universal single payer healthcare. Anyone willing to look honestly at the data will find that free market strategies have not worked in healthcare but have in fact increased costs, complexity and confusion. We have created a medical/healthcare system for the rich and the highest bidder. Obamacare does not rectify that problem. It did take important steps in that direction, however, and needs to be defended.

    Support ACA. Keep ACA. Strengthen ACA. We need eventually to get to a universal national health program. But right now we need to Keep ACA. I depend upon the individual market of ACA for my health insurance. Keep ACA. Keep essential health benefits. Keep real pre existing conditions coverage. Keep ACA.

    Obamacare has to go. Keep coverage for preexisting conditions and be on parents healthcare until age of 26, other than that Obamacare was a disaster.
