SCOTUS Won’t Hear LGBT Job Discrimination Case

What’s the story?
The Supreme Court has refused to hear a case challenging if sex discrimination protections in employment extend to sexual orientation.
By declining the case, SCOTUS leaves in place a lower court ruling that a federal employment discrimination law doesn’t protect a person based on sexual orientation.
Why does it matter?
The case originated with Georgia hospital worker Jameka Evans, who claimed she was fired from her job because she’s a lesbian.
The Obama administration had argued that the Equal Employment Opportunity Commission banned workplace discrimination based on orientation. But the Trump administration took the position that Title VII of the Civil Rights Act of 1964 - which bars discrimination based on gender - doesn’t cover sexual orientation.
"By declining to hear this case, the Supreme Court is delaying the inevitable and leaving a split in the circuits that will cause confusion across the country," said Greg Nevins of Lambda Legal, which represented Evans.
Nevins continued:
"But this was not a 'no,' but a 'not yet.'"
