Trump Admin Asks Supreme Court to Hear Transgender Military Ban Challenge

Do you support Trump's policy restricting transgender people from military service?

by Axios | Updated on 11.26.18

The Trump administration asked the Supreme Court on Friday to hear a challenge to President Trump's policy restricting transgender people from serving in the military, CNN reports.

Why it matters: With its request, Trump is again making an effort to circumvent federal appeals courts, per NYT. District courts have blocked the policy from going into effect thus far with the 9th Circuit Court of Appeals having already heard arguments in one challenge earlier this fall and the D.C. Circuit set to hear arguments in December.

Getting sex changes on taxpayer dollars, taking them out of the duty line for months at a time after the operation? That's like taking money from the taxpayers and giving them the middle finger. Should they be allowed to enlist? No. Most of them aren't even mentally stable, and you're going to give them combat training? Do your research. Statistics show most of them suffer from mental instabilities.

President Bone spur and never served (Mike Pence) policy restricting transgender people from serving in the military. I and my brothers served in the military. How would he or any of his family and Mike Pence know anything about the military, they never served. Mike's dad Did, gee. I known some LGBT people, they are good people, I can't say that about the people, that are against them and others groups. You might try talking to them and others for once. The religious right and wackos, stereo type people of all groups by other's misinformation and uninformed people. Just like gassing men, women and children at the boarder, that will teach them to come here to survive. Or maybe the 1000's of immigrants children that are now screwup for the rest of their life that were taken away from their families, talk about child abuse on a presidential scale! You people need to get a life or look one up.

    1. This isn’t Trump’s policy, it’s Pence’s. 2 There’s no reason transgender folks should be barred from serving as long as they meet all the requirements.

These people are not mentally stable. There’s no room for that in the military

If this does go to the SC, it should be very interesting. Good pro and con arguments can be made on this issue.

I am having trouble deciding which behavior is more disgusting - the ban arbitrarily announced by a man who does not relate to other humans on ANY level deemed appropriate by modern society OR the blatant attempt to, once again, weaken the institutions on which our democracy depends. Remember, this is the President of the United States attempting to SUBVERT the democratic NORMS he was supposedly elected to uphold and defend. I do NOT, NOR do I wish to, live in a kleptocracy. If members of Congress, also elected to uphold our democratic way of life, don't get a grip on reality, put country above stupidity and DO THEIR JOBS SOON, we will watch our way of life crumble permanently - something I doubt your constituents had in mind when you were elected.

Yes, let’s take the country backwards. Trump is only playing to his crazy right wing base, he could care less what the majority of Americans think.

Not only is this ban unconstitutional, it is morally repugnant. As not only a legislator, but as a decent American citizen, or even just a decent person, you should be fighting for ALL Americans to have equal rights and opportunities in Florida and across the country. This includes the LGBTQ+ community. Stand up for the people in your state especially the marginalized ones. If you are not going to let these unbelievably brave men and women serve our country and fight for our freedom, then I will make it my mission to elect whoever runs against you.

It’s MOOT. They are people. THEY DESERVE THE SAME RIGHTS AS EVERYONE ELSE. Besides Trump doesn’t have the RIGHT to skip the other Judicial courts if he’s going with this. What Happened to Trump saying he’d protect the LGBTQ community??? Course what happened to keeping jobs GM is laying off 20,000 workers & closing 3 factories?? What happened to the payments from his salary to the Veterans organizations??? What happened to the payments to the farmers to make up for the Tariffs?? JUST LIKE EVERYTHING ELSE. ALL BLOW, NO DO.

There is no emergency, there is no reason to restrict transgender soldiers from serving, especially when we have a shortage of people enlisting. This is homophobic and extremist behavior with no evidence to support it. I hope the Supreme Court denies his request, but if he doesn't I am still waiting for Congress to act to protect all people from discrimination, including LGBT+ servicemembers.

As long as you do your job and are willing to die for this country, it should not matter. Just one thing the military does not pay for or conduct transgender operations. Also no special treatment for quarters. You get what you get, and don’t throw a fit.

I certainly hope the Supreme Court decides to leave this to a lower court’s ruling. This administration needs to realize that human rights are valued by Americans. How about focusing instead on those migrant children being held in camps? This administration and the DHS need to deal with significant issues, not fabricated ones.

    1. The American public shouldn't have to pay for the surgeries for these people. 2. The transgender would effect unit readiness. 3. The transgender would effect unit cohesion. These things aren't me being mean. Just being realistic. I don't care what these people do on their own time. But if it effects our military readiness or unit behavior, then it's a problem.

The President needs to stop interfering in the judicial system. The court has ruled regarding transgendered individuals serving in the military. It is not his place to ask the Supreme Court to rule on that. Would someone give this President a copy of the constitution or an audio copy?

I really don’t think anyone who has never served should be giving an opinion on this. Personally I served with lesbians and that did not bother me but if I had to shower with men who wanted to claim to be a woman we would have some major issues. Civilians don’t understand community showers, when there are 30+ sometimes a lot more than that woman sharing a large shower room. Nobody wants to see a pecker flipping around in the shower and if he got an erecting in that situation it would be really an ugly situation. In the reverse putting a female body in a male shower is s recipe for rapes and other issues and when you’re in training or deployed and in these situations nobody has time to cater to anyone’s individual and eccentric needs.

The military bars those who require maintenance medication from serving. Regardless of sex, sexual preference. Why would we risk it for one and not for all?
