FDA May Ban Online Vaping Sales

The Food and Drug Administration is considering a ban on the online sale of e-cigarettes, Commissioner Scott Gottlieb said at an Axios News Shapers event this morning. New limits on flavored products are also on the table, he said; the agency will release new data about teen vaping and announce its next steps in November.

Why it matters: Gottlieb has consistently said e-cigarettes can be a safer option for adults who smoke cigarettes, but that the products are "too appealing" and "too accessible" to children and teens. Regulations to ban or at least curb online sales or flavored products could come soon, Gottlieb said today.

  • The FDA in November also is planning to release new e-cig usage data, which will show that year-over-year usage among high schoolers has risen by at least 80% (. It also will detail middle-school usage increases, which is lower than the high school figure but still quite high.
  • The vaping companies aren't tipping their hands, but expect them to suggest tech-based age verification solutions for both point-of-sale and online purchases. But it would be impossible for them to guarantee either one — the former because they can't really control a retail counter, and the latter because they can't effectively stop online resale. So it's really a question of what level of "proof" Gottlieb is really going to require to stem what he today termed a "public health emergency."
  • NJoy, an early e-cig company that went bankrupt in 2016 after having been valued at around $1.2 billion by private investors like Fidelity, just raised $49 million in new equity funding, per an SEC filing. Unclear if there are any new investors beyond Homewood Capital, which bought NJoy out of bankruptcy, but there is a new CEO whose last job appears to have been running a Los Angeles-area landscaping company.

    Vaping has helped hundreds of thousands of people including myself quit smoking. But it’s like anything product, there’s aways some form of risk. Teens will always find a way to get what they want - alcohol, tobacco based products, marijuana you name it. There is no way for any industry to have a fail safe method that stops the wrong people from getting what they want. So if they plan to try and ban e-cigarettes, then the products will go underground. Put the proper regulations in place, hold accountable the bad players and move on. A ban would just make folks who have stopped smoking shift back to cigarettes, cigars, whatever and the teens will follow.

    Prohibition only increases the perceived value of an item. Good treatments. Dont treat at the symptoms treat they trest the disease.

    Imagine if your vape pen could also shoot bullets...then the right would be all like “You aren’t going to take my vape gun! it’s our right to vape arms, it says so in the constitution!” (Sometimes I wonder if the only thing the right stands for is the right to love hypocrisy)

    I have quit smoking for over 5 years by switching to vaping.     We have bigger issues than this. Honestly. And to be frank, just because you ban them from buying online, won’t change the fact that kids, teens, etc will still very easily find access to these things. Id rather my kids have access to a vape than deciding to bum cigarettes off people instead. Parents should be dealing with their children, and YOU should be dealing with things that matter more in this country.

    Vaping is healthier than smoking. So justification to prevent it is a purr political restriction with out merit. It is a cheaper product than smoking and is not taxed as tobacco is so this is to eliminate a competitive alternate to the high profitable government tax.

    As a person who owns an e liquid brand and manages a retail vape shop I support restricting online sales to only business to business transactions in order to prevent youth access but for adults this has been a life saving product that has helped countless people get off and stay off cigarettes. Teens should not have easy access to these products and young adults who have never smoked cigarettes shouldn’t be vaping! Well people will make their own decisions based on truthful information and the government needs to step back and stop destroying the meaning of the word freedom

    Great work. Don’t go after the bad stuff that effects us all. If I had a kid who was into doing drugs, I’d say trade that for vaping. 🖕Just because the FDA doesn’t have all of the facts about harmful effects of vaping, why are they so quick to denounce it? Investigate! Do your job. Or, have you been bought by lobbyists?
